Definitons:
“User”, “Account”, “Member”, "Customer", or “Client”: Person or representative of someone who uses/applies for services provided by Ceelo2000 Web Designs and Hosting.
“We”, “Us”: Ceelo2000 Web Designs and Hosting.
1. Compliance with Laws:
The Customer will ensure that its use of the Internet complies with all applicable federal, state, and local laws and regulations, including (but not limited to) those principles of law which protect against compromise of copyrights, trade secrets, proprietary information and other intellectual property rights, libel or defamation of character, invasion of privacy, tortious interference, and export of technical or military data to prohibited countries.
2. Knowledge of the Internet:
The Customer agrees to obtain a basic knowledge of the Internet and its operating principles and procedures.
3. Pornography:
Ceelo2000 as a public Internet provider does not censor legal web content in any way. However we do charge sites that transfer more than 2GB per month and adult sites quite often fall into this category.
4. Refusal of Service:
We reserve the right to refuse or terminate service to anyone for any reason.
5. Security:
The customer is required to protect the security of its internet account and usage. The customer's password will be treated as private and confidential and will not be disclosed to or shared with any third parties. Customers conducting online commerce transactions through their web sites are responsible for the security of all such transactions, and shall not hold we, its agents, or employees liable for any incidental or consequential damages arising from such transactions. we recommends the use of SSL and PGP (or another encryption/decryption tool), but does not provide any warranty or guarantee for these products.
6. Storage:
Files on our servers must be for web site purposes only. Storage of unrelated files or use of our servers for the backup of files is strictly prohibited.
7. Suspension:
Activity that results in an account being suspended will result in loss of fees paid. No refunds will be made. Damages caused by the account will result in financial loss to the customer. Any complaints arising as a result of client activity will be obvious grounds for suspension.
8. Validation of Information:
The customer is responsible for validating the integrity of the information and data it receives or transmits over the Internet.
9. Improper Uses:
The customer will avoid violation of certain generally accepted guidelines on Internet usage, such as:
- Using a non-existent e-mail return address on a commercial solicitation
- Spamming (sending unsolicited advertising to numerous e-mail addresses or newsgroups and/or generating a significantly higher volume of outgoing e-mail than a normal user)
- Trolling (posting outrageous messages to generate numerous responses)
- Mail-bombing (sending multiple messages without significant new content to the same user)
- Subscribing someone else to a mailing list without that person's permission
- Cross-posting articles to an excessive number of newsgroups
- Attempting without authorization to enter into a secured computer system
we reserves the right to determine what constitutes improper use.
10. Harm to minors:
Use of our service to harm, or attempt to harm, minors in any way, including, but not limited to child pornography is strictly prohibited.
11. Threats:
Use of our service to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property is strictly prohibited.
12. Harassment:
Use of our service to transmit any material (by e-mail, uploading, posting or otherwise) that harasses another is strictly prohibited.
13. Fraudulent activity:
Use of our services to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as "pyramid schemes", "ponzi schemes", and "chain letters" is strictly prohibited.
14. Forgery or impersonation:
Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous re-mailers or nicknames does not constitute impersonation.
15. Copyright or trademark infringement:
Use of our service to transmit any material (by e-mail, uploading, posting or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.
16. Fraud:
Involves a knowing misrepresentation or misleading statement, writing or activity made with the intent that the person receiving it will act upon it.
17. Infringement of Copyright, Patent, Trademark, Trade Secret, or Intellectual Property Right:
Distribution and/or posting of copyrighted or the aforementioned infringements will not be tolerated.
18. Distribution of Viruses:
Intentional distributions of software that attempts to and/or causes damage, harassment, or annoyance to persons, data, and/or computer systems are prohibited. Such an offense will result in the immediate termination of the offending account.
19. Inappropriate Use of Software:
Use of software or any device that would facilitate a continued connection, i.e. pinging, while using our services could result in suspension of service. Report violations to abuse@ceelo2000web.net.
20. Bandwith:
We offer a set monthly bandwith allowance. Any acccount that uses over this set limit (varies upon plan) will be charged $5.00 per 2 gigabyte segments. Overage payments will be charged at the end of the billing cycle in which the extra bandwith was consumed.
21. Excessive Resource Consumption:
Resources are defined as bandwidth and/or processor utilization. If an account is found to be utilizing an excess amount of resources, we reserves the right to cancel an account, or move the account to a dedicated server upon consent of the user.
22. Cancellation:
We must receive written consent stating that you wish to discontinue your service. Mail, e-mail, and fax are all acceptable methods of canceling your service. We must receive this written consent 7 days prior to account renewal.
23. Backups
We have nightly onsite backups of all website files, which are kept on a 30 day rolling basis. We cannot guarantee the availability of backups, or ensure that they will always be available. We highly recommend that you keep your own backups of your website. In the event that you need us to retrieve a backup for you, we will charge an administrative fee. Backup requests are usually processed within 48 hours.
24. Account Information
The customer is responsible for maintaining accurate billing information and account information. In the event service is disrupted or terminated as a result of innacurate or outdated information, we shall in no way be responsible for any losses or expenses incurred by a customer.
25. Payment
Payments made to Ceelo2000 through credit card are processed through PayPal on a yearly or monthly basis, from the date of sign up. In the event that payment fails for any reason, you will be notified via e-mail and will be given 5 days to provide us with correct billing information. If, after 5 days, we are still unable to charge you, we will suspend your account until you correct your billing information with us. If, after 20 days of suspension, we are still unable to charge you, we will terminate your hosting service for nonpayment.
Once your hosting service is terminated, any and all files associated with your account will be permanently removed from our servers. We are not responsible for any losses or expenses incurred by a customer as a result of any action taken as a result of nonpayment.
26. Modification:
We reserve the right to add, delete, or modify any provision of this policy at any time without notice.
